Using our websites is generally possible without providing any personal data. Cookies

This website uses cookies. Cookies are small text files that are sent by a web server to your browser and stored on your computer’s hard drive. Apart from the Internet Protocol address, no personal data of the user are stored. This information is used to automatically recognise you on your next visit to our websites and to facilitate navigation. When you visit our websites, our web servers automatically store general information in anonymised form for marketing and optimisation purposes.

This generally includes the type of web browser, the operating system used, the domain name of your Internet service provider, the IP address assigned to you by your Internet service provider, the website from which you visit us, the pages you visit on our site, as well as the date and duration of the visit. This information does not allow further conclusions to be drawn about your person. Personal data are only stored if you provide them to us yourself, for example as part of a registration, a survey or for the execution of a contract. By using cookies, more user-friendly services can be provided to visitors to this website that would not be possible without cookies. The information and offers on this website can be optimised in the interest of users through cookies. Recognition of users makes it easier to use this website. For example, a user of a website that uses cookies does not need to re-enter their login data on each visit. Online shops can use cookies to remember the items a customer has placed in the virtual shopping cart. Visitors can prevent the use of cookies by this website at any time via the settings of their internet browser and thus permanently object to the use of cookies. Cookies that have already been set can be deleted in all common Internet browsers or via other software programs. If the use of cookies is blocked or deactivated by the user, not all functions of this website may be usable.

Registration on this website (e.g., online booking)

The data subject has the possibility to register on the controller’s website by providing personal data. Which personal data are transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject are collected and stored exclusively for internal use by the controller and for its own purposes. The controller may arrange for transfer to one or more processors (for example, a mailing service provider or survey forms via the service "Typeform" (https://www.typeform.com/help/what-happens-to-my-data/)), who also use the personal data exclusively for an internal use attributable to the controller. When registering on the controller’s website, the IP address assigned by the Internet service provider (ISP) to the data subject, the date and time of registration are also stored. The storage of these data takes place against the background that this is the only way to prevent misuse of our services, and these data, if necessary, make it possible to clarify crimes and copyright infringements committed. In this respect, the storage of these data is necessary to secure the controller. These data will not be passed on to third parties unless there is a legal obligation to pass them on or the transfer serves criminal or legal prosecution.

The registration of the data subject by voluntarily providing personal data allows the controller to offer content or services to the data subject that, by their nature, can only be offered to registered users. Registered persons are free to have the personal data provided during registration completely deleted from the controller’s database. The controller provides any data subject with information upon request at any time about which personal data concerning the data subject are stored. Furthermore, the controller rectifies or deletes personal data at the request or indication of the data subject, insofar as there are no statutory retention obligations to the contrary.

Contact

Personal data are also processed by Abion Hotel Verwaltungs GmbH & Co. Betriebs KG if you provide them yourself. This happens, for example, whenever you contact us. We will of course use the personal data transmitted in this way exclusively for the purpose for which you provide them to us when contacting us. Providing this information is expressly voluntary and with your consent. If this involves information on communication channels (for example, email address, telephone number), you also consent to us contacting you via this communication channel to answer your inquiry.

Security

Abion Hotel Verwaltungs GmbH & Co. Betriebs KG takes numerous technical and organisational measures to protect your personal data against accidental or unlawful deletion, alteration or loss and against unauthorised disclosure or access. Nevertheless, internet-based data transmissions can in principle have security gaps, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us via alternative means, for example by telephone.

Links to other websites

This website contains links to other websites (so-called external links). Abion Hotel Verwaltungs GmbH & Co. Betriebs KG is responsible for its own content in accordance with the applicable European and national legal provisions. These own contents are to be distinguished from links to contents provided by other providers. We have no influence on whether the operators of other websites comply with the applicable European and national legal provisions. Please inform yourself about the privacy policies provided on the respective website. Abion Hotel Verwaltungs GmbH & Co. Betriebs KG assumes no responsibility for third-party content that is made available for use via links and specially marked, and does not adopt its content as its own. Only the provider of the website to which reference is made is liable for illegal, incorrect or incomplete content and for damages arising from the use or non-use of the information.

Collection of General Data and Information

Each time the website of Abion Hotel Verwaltungs GmbH & Co. Betriebs KG is accessed by a data subject or an automated system, a series of general data and information is collected. These general data and information are stored in the server log files. The following may be collected: (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system arrives at our website (so-called referrer), (4) the subpages accessed on our website by the accessing system, (5) the date and time of access to the website, (6) an Internet Protocol address (IP address), (7) the Internet service provider of the accessing system and (8) other similar data and information that serve to avert danger in the case of attacks on our IT systems. When using these general data and information, Abion Hotel Verwaltungs GmbH & Co. Betriebs KG does not draw any conclusions about the data subject. Rather, this information is needed to (1) correctly deliver the contents of our website, (2) optimise the contents of our website as well as the advertising for it, (3) ensure the long-term functionality of our IT systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. These anonymised data and information are therefore statistically evaluated by Abion Hotel Verwaltungs GmbH & Co. Betriebs KG and further with the aim of increasing data protection and data security. The anonymised data of the server log files are stored separately from all personal data provided by a data subject.

This website also uses Facebook’s visitor action pixel for conversion measurement, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). This allows the behaviour of site visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. As a result, the effectiveness of Facebook advertisements can be evaluated for statistical and market research purposes and future advertising measures can be optimised. The data collected are anonymous to us as operators of this website; we cannot draw any conclusions about the identity of users. However, the data are stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with Facebook’s data usage policy. This enables Facebook to place advertisements on Facebook pages and outside of Facebook. We as site operators cannot influence this use of the data. The use of Facebook pixel takes place on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in effective advertising measures including social media. Further information on the protection of your privacy can be found in Facebook’s privacy notices: https://de-de.facebook.com/about/privacy/. You can also deactivate the remarketing function "Custom Audiences" in the settings for advertisements under https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do this. If you do not have a Facebook account, you can deactivate usage-based advertising from Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

Subscription to our Newsletter

Users are given the opportunity on the website of Abion Hotel Verwaltungs GmbH & Co. Betriebs KG to subscribe to the company’s newsletter. Which personal data are transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose. Abion Hotel Verwaltungs GmbH & Co. Betriebs KG informs its customers and business partners at regular intervals by means of a newsletter about offers of the company. The newsletter of our company can generally only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter mailing. For legal reasons, a confirmation email is sent to the email address entered by a data subject for the first time for newsletter mailing in the double opt-in procedure. This confirmation email serves to verify whether the owner of the email address as the data subject has authorised the receipt of the newsletter. When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject at the time of registration as well as the date and time of registration. The collection of these data is necessary to be able to trace the (possible) misuse of the email address of a data subject at a later date and thus serves the legal safeguarding of the controller. The personal data collected when registering for the newsletter are used exclusively for sending our newsletter. Subscribers may also be informed by email if this is necessary for the operation of the newsletter service or for a related registration, as might be the case in the event of changes to the newsletter offer or changes to the technical circumstances. The personal data collected as part of the newsletter service are not passed on to third parties. The subscription to our newsletter can be terminated by the data subject at any time. The consent to the storage of personal data that the data subject has given us for the newsletter mailing can be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in every newsletter. Furthermore, there is the possibility to unsubscribe from the newsletter mailing at any time directly on the website of the controller or to communicate this to the controller in another way.

Newsletter Tracking

The newsletters of Abion Hotel Verwaltungs GmbH & Co. Betriebs KG contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such emails which are sent in HTML format to enable log file recording and log file analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Using the embedded tracking pixel, Abion Hotel Verwaltungs GmbH & Co. Betriebs KG can recognise whether and when an email was opened by a data subject and which links contained in the email were called up by the data subject. Personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the controller to optimise newsletter mailing and to better tailor the content of future newsletters to the interests of the data subject. These personal data are not passed on to third parties. Data subjects are entitled at any time to revoke the separate consent declaration given via the double opt-in procedure. After revocation, these personal data are deleted by the controller. Unsubscribing from receiving the newsletter is automatically interpreted by Abion Hotel Verwaltungs GmbH & Co. Betriebs KG as a revocation.

Contact via the website

The website of Abion Hotel Verwaltungs GmbH & Co. Betriebs KG contains information due to legal provisions that enables quick electronic contact to our company as well as immediate communication with us, which also includes a general address of what is known as electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. There is no transfer of these personal data to third parties.

Routine Deletion and Blocking of Personal Data

The controller processes and stores personal data of the data subject only for the period necessary to achieve the storage purpose or insofar as this is provided for by the European legislator or another legislator in laws or regulations to which the controller is subject. If the storage purpose ceases to apply or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or deleted in accordance with the legal provisions.

Rights of the Data Subject

Every data subject has the right granted by the European legislator to obtain confirmation from the controller as to whether personal data concerning him or her are being processed. If a data subject wishes to exercise this right to confirmation, he or she may contact an employee of the controller at any time.

Right of Access
Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain, free of charge, information from the controller at any time about the personal data stored about him or her and a copy of this information. Furthermore, the European legislator has granted the data subject information about the following: the purposes of processing; the categories of personal data processed; the recipients or categories of recipients to whom the personal data have been disclosed or will be disclosed, in particular recipients in third countries or international organisations; if possible, the planned duration for which the personal data will be stored, or, if this is not possible, the criteria for determining this duration; the existence of a right to rectification or erasure of personal data concerning him or her or restriction of processing by the controller or a right to object to such processing; the existence of a right to lodge a complaint with a supervisory authority; if the personal data are not collected from the data subject, all available information about the origin of the data; the existence of automated decision-making including profiling pursuant to Article 22(1) and (4) GDPR and — at least in these cases — meaningful information about the logic involved as well as the significance and the envisaged consequences of such processing for the data subject. The data subject also has a right to information as to whether personal data have been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to be informed of the appropriate safeguards relating to the transfer.

Right to Rectification
Every data subject affected by the processing of personal data has the right granted by the European legislator to request the immediate rectification of inaccurate personal data concerning him or her. Furthermore, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data — including by means of a supplementary statement.

Right to Erasure (Right to be Forgotten)
Every data subject affected by the processing of personal data has the right granted by the European legislator to demand from the controller that personal data concerning him or her be erased without undue delay, where one of the following reasons applies and insofar as the processing is not necessary: the personal data were collected or otherwise processed for purposes for which they are no longer necessary; the data subject withdraws consent on which the processing is based pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, and there is no other legal basis for the processing; the data subject objects to the processing pursuant to Art. 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Art. 21(2) GDPR; the personal data have been unlawfully processed; the erasure of the personal data is necessary to comply with a legal obligation under Union or Member State law to which the controller is subject; the personal data were collected in relation to the offer of information society services pursuant to Art. 8(1) GDPR. If one of the above reasons applies and a data subject wishes to arrange for the erasure of personal data stored by Abion Hotel Verwaltungs GmbH & Co. Betriebs KG, he or she may contact an employee of the controller at any time. The employee of Abion Hotel Verwaltungs GmbH & Co. Betriebs KG will arrange for the request for erasure to be complied with without delay. If personal data have been made public by Abion Hotel Verwaltungs GmbH & Co. Betriebs KG and our company as controller is obliged to erase the personal data pursuant to Art. 17(1) GDPR, Abion Hotel Verwaltungs GmbH & Co. Betriebs KG shall, taking into account available technology and the costs of implementation, take reasonable steps, including technical measures, to inform other controllers processing the published personal data that the data subject has requested erasure by those controllers of any links to, or copies or replications of, those personal data, insofar as processing is not necessary.

Right to Restriction of Processing
Every data subject affected by the processing of personal data has the right granted by the European legislator to require the controller to restrict processing where one of the following conditions applies: the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data; the processing is unlawful, the data subject refuses the erasure of the personal data and requests restriction of use of the personal data instead; the controller no longer needs the personal data for the purposes of processing, but the data subject needs them for the establishment, exercise or defence of legal claims; the data subject has objected to processing pursuant to Art. 21(1) GDPR and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

Right to Data Portability
Every data subject affected by the processing of personal data has the right granted by the European legislator to receive the personal data concerning him or her, which the data subject has provided to a controller, in a structured, commonly used and machine-readable format. He or she also has the right to transmit these data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. In exercising his or her right to data portability pursuant to Art. 20(1) GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.

Right to Object
Every data subject affected by the processing of personal data has the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on Art. 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions. Abion Hotel Verwaltungs GmbH & Co. Betriebs KG shall no longer process the personal data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims. Where Abion Hotel Verwaltungs GmbH & Co. Betriebs KG processes personal data for direct marketing purposes, the data subject has the right to object at any time to processing of personal data for such marketing. This also applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to Abion Hotel Verwaltungs GmbH & Co. Betriebs KG to processing for direct marketing purposes, Abion Hotel Verwaltungs GmbH & Co. Betriebs KG will no longer process the personal data for these purposes. The data subject also has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her which is carried out by Abion Hotel Verwaltungs GmbH & Co. Betriebs KG for scientific or historical research purposes or for statistical purposes pursuant to Art. 89(1) GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

Automated Individual Decision-Making including Profiling

Every data subject affected by the processing of personal data has the right granted by the European legislator not to be subject to a decision based solely on automated processing — including profiling — which produces legal effects concerning him or her or similarly significantly affects him or her, unless the decision (1) is necessary for entering into, or performance of, a contract between the data subject and the controller, or (2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is based on the data subject’s explicit consent. Where the decision (1) is necessary for entering into, or performance of, a contract between the data subject and the controller or (2) is based on the data subject’s explicit consent, Abion Hotel Verwaltungs GmbH & Co. Betriebs KG shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

Right to Withdraw Consent

Every data subject affected by the processing of personal data has the right granted by the European legislator to withdraw consent to processing of personal data at any time.

DialogShift chat application on our website

Our website uses the chat application of DialogShift GmbH, Rheinsberger Str. 76/77, 10115 Berlin. This application processes and stores data for the purpose of web analytics, operating the chat application and responding to inquiries. For operating the chat function, chat texts are stored and a cookie with a unique ID is set — this serves to recognise you as a customer. A cookie is a small text file stored locally in the cache on your device. Using this cookie, our application recognises the device and can retrieve past chat logs. This cookie is stored for 90 days since last use. You can deactivate the storage of cookies in your browser settings. However, without the use of cookies, the chat function cannot be operated. The possible disclosure of e.g. name, email address or a telephone number is voluntary and with consent to temporarily use and store this data for the purpose of contacting you until the end of the contact. These personal data are deleted after 90 days. The legal basis for data processing is Art. 6(1)(f) GDPR on the basis of our legitimate interest in effective customer support, statistical analysis of usage behaviour and for optimisation purposes of our services. DialogShift provides further information on data collection and use as well as on your rights and options for protecting your privacy at https://www.dialogshift.com/datenschutz.

Data protection in applications and recruitment

The controller collects and processes the personal data of applicants for the purpose of processing the application procedure. Processing may also be carried out electronically. This is particularly the case if an applicant submits the relevant application documents electronically, for example by email or via a web form on the website, to the controller. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with statutory provisions. If no employment contract is concluded by the controller with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller stand in the way of deletion. Another legitimate interest in this sense is, for example, a duty of proof in proceedings under the General Equal Treatment Act (AGG).

Data Protection Provisions on the Use of Facebook

The controller has integrated components of the company Facebook on this website. Facebook is a social network. A social network is an Internet-based social meeting place, an online community that generally enables users to communicate among themselves and interact in the virtual space. A social network can serve as a platform for exchanging opinions and experiences or enables the Internet community to provide personal or company-related information. Facebook enables users of the social network to create private profiles, upload photos and network via friend requests. The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. For the processing of personal data, the controller, if a data subject lives outside the USA or Canada, is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. By each call-up of one of the individual pages of this website operated by the controller and on which a Facebook component (Facebook plug-in) has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Facebook component to download a display of the corresponding Facebook component from Facebook. An overview of all Facebook plug-ins can be retrieved at https://developers.facebook.com/docs/plugins/?locale=de_DE. In the course of this technical procedure, Facebook receives knowledge of which specific subpage of our website is visited by the data subject.

If the data subject is logged in to Facebook at the same time, Facebook recognises with each visit to our website by the data subject and during the entire duration of his or her stay on our website which specific subpage of our website the data subject visits. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject presses one of the Facebook buttons integrated on our website, for example the "Like" button, or the data subject submits a comment, Facebook assigns this information to the personal Facebook user account of the data subject and stores these personal data. Facebook receives information via the Facebook component whenever the data subject visits our website, if the data subject is logged in to Facebook at the time of calling our website; this occurs regardless of whether the data subject clicks the Facebook component or not. If such transmission of information to Facebook is not desired by the data subject, he or she can prevent transmission by logging out of his or her Facebook account before calling our website. The data policy published by Facebook, which is available at https://de-de.facebook.com/about/privacy/, provides information about the collection, processing and use of personal data by Facebook. Furthermore, it is explained there which settings Facebook offers to protect the privacy of the data subject. In addition, different applications are available which make it possible to suppress data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.

Data Protection Provisions on the Use of Twitter

The controller has integrated components of Twitter on this website. Twitter is a multilingual publicly accessible microblogging service on which users can publish and disseminate short messages known as tweets, limited to 140 characters. These short messages are accessible to everyone, i.e., also for persons not registered with Twitter. The tweets are also shown to the so-called followers of the respective user. Followers are other Twitter users who follow the tweets of a user. Furthermore, Twitter enables addressing a broad audience via hashtags, links or retweets. The operating company of Twitter is Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. By each call-up of one of the individual pages of this website operated by the controller and on which a Twitter component (Twitter button) has been integrated, the Internet browser on the information technology system of the data subject is automatically prompted by the respective Twitter component to download a display of the corresponding Twitter component from Twitter. Further information on the Twitter buttons can be retrieved at https://about.twitter.com/de/resources/buttons. In the course of this technical procedure, Twitter is informed which specific subpage of our website is visited by the data subject. The purpose of integrating the Twitter component is to enable our users to redistribute the content of this website, to make this website known in the digital world and to increase our visitor numbers.
